How to register a boat in Ukraine

Key points in the draft Law for own­ers of small boats, i.e. for us it is:

  • boat longer than 4 meters — reg­is­tered
  • a boat with an engine more pow­er­ful than 12 kW — is reg­is­tered, regard­less of its length
  • boat up to 4 meters inclu­sive with a motor up to 12 kW inclu­sive — not reg­is­tered

Accord­ing to the res­o­lu­tions of the Cab­i­net of Min­is­ters of Ukraine, small boats (see the table below) are sub­ject to manda­to­ry reg­is­tra­tion with the assign­ment of a reg­is­tra­tion num­ber, this is done by the State Ser­vice of Ukraine for trans­port safe­ty — Ukr­trans­bezpe­ka, which car­ries out state reg­is­tra­tion of ships in accor­dance with the pro­ce­dure for main­tain­ing the State Ship Reg­is­ter of Ukraine and the Ship Book of Ukraine approved by the Decree of the Cab­i­net of Min­is­ters of Ukraine dat­ed Sep­tem­ber 26, 1997 N 1069.

In addi­tion to reg­is­tra­tion, all small ves­sels are required to under­go annu­al tech­ni­cal inspec­tions at the offices of the Ukrain­ian Ship­ping Reg­is­ter, which car­ries out tech­ni­cal super­vi­sion and clas­si­fi­ca­tion of ves­sels, in accor­dance with the Res­o­lu­tion of the Cab­i­net of Min­is­ters of Ukraine dat­ed 08.06.1998 N 814.

Own­ers of motor­ized boats and boats are addi­tion­al­ly required to pass cer­ti­fi­ca­tion (cours­es) for the right to dri­ve a small boat.

The oper­a­tion of water trans­port is reg­u­lat­ed in accor­dance with the Rules for nav­i­ga­tion on the inland water­ways of Ukraine, plus many regions of Ukraine have their own rules for nav­i­ga­tion in inland waters.

Which boats need to be registered

Accord­ing to the Decree of the Cab­i­net of Min­is­ters “On the approval of the Pro­ce­dure for main­tain­ing the State Ship Reg­is­ter of Ukraine and the Ship Book of Ukraine dat­ed Sep­tem­ber 26, 1997 N 1069” Small ves­sels not sub­ject to reg­is­tra­tion: “The effect of this Pro­ce­dure does not apply to: row­ing ves­sels used with­out an engine, up to 2.5 meters.” Clause 2 was sup­ple­ment­ed by a para­graph in accor­dance with Res­o­lu­tion of the CM No. 933 (933‑2008‑п) dat­ed 10.22.2008

Now in Ukraine, for a Sale and Pur­chase Agree­ment for used boats and out­board motors, it is nec­es­sary to con­clude not at Com­mod­i­ty Exchanges, but through Notaries and Com­mis­sion shops (entre­pre­neurs engaged in com­mis­sion trade).

From Feb­ru­ary 1, 2014, the Reg­is­ter of Ship­ping of Ukraine can­celed the annu­al inspec­tion of small ves­sels!

In accor­dance with the changes made to the “Rules for the inspec­tion of small ves­sels in oper­a­tion”, the annu­al tech­ni­cal inspec­tion has been can­celed. The inter­val between peri­od­ic sur­veys of small ves­sels for class con­fir­ma­tion has been sig­nif­i­cant­ly increased. This applies to motor­ized small ves­sels with a pow­er of main engines less than 55 kW (75 hp), sail­ing, non-self-pro­pelled and park­ing small ves­sels. Small ves­sels with a 5‑year class valid­i­ty peri­od will under­go a peri­od­ic sur­vey to con­firm the class once every 2.5 years; with a 6‑year term of valid­i­ty of the class — 1 time in 3 years; with an 8‑year term of valid­i­ty of the class — 1 time in 4 years.

If it is planned to go to sea at a dis­tance of more than 2 miles from the coast, then no lat­er than one hour before the depar­ture of the float­ing craft, it is nec­es­sary to noti­fy the sub­di­vi­sion of the State Bor­der Guard Ser­vice of Ukraine. Also, when going to sea out­side the two-mile zone, it is manda­to­ry to have on board the float­ing craft radio-elec­tron­ic means of com­mu­ni­ca­tion and per­mis­sion to use them.

Pre­vi­ous­ly, even in order to set sail from the shore, the own­ers of small boats were required to pass the so-called. “tem­po­rary reg­is­tra­tion” with the bor­der guards: give a descrip­tion of the route, copies of doc­u­ments for the boat, copies of the doc­u­ments of those who will go to sea. The very fact of mov­ing away from the coast with­out such infor­ma­tion was regard­ed as a vio­la­tion of the bor­der regime and entailed admin­is­tra­tive respon­si­bil­i­ty.

But also, accord­ing to the “Reg­u­la­tions on the cor­don regime”, the own­ers of small boats are oblig­ed, with­in 24 hours from the moment of arrival in the bor­der strip or con­trolled bor­der area, to reg­is­ter with the admin­is­tra­tion of the near­est pier, berth or base point in accor­dance with the pro­ce­dure estab­lished by the “Rada of Min­is­ters of Crimea” and region­al and Sev­astopol city state admin­is­tra­tions.

At piers, berths and base points, it is pro­hib­it­ed to store, nav­i­gate and move small boats that are not duly reg­is­tered with the author­i­ties that super­vise such boats.
